Charges dropped against man allegedly involved in Airway Heights shooting that left one dead

The investigation remains ongoing, but the five counts of second-degree assault against Devine D. Bullard will be dismissed "without prejudice."

AIRWAY HEIGHTS, Wash. — New court documents have confirmed that charges have been dropped against the man involved in a deadly shooting in Airway Heights back in February.

Thirty-year-old Devine D. Bullard was originally booked into the Spokane County Jail on five counts of second-degree assault. At the time of the shooting, Airway Heights police officers said they received a call just before 8:45 p.m. on Sunday, February 4. When they arrived, they found a 28-year-old man who had been shot. Police provided life-saving measures, but the man did not survive his injuries.

Police said that initial information indicated an argument quickly escalated into a physical altercation. They also believe that pepper spray or bear mace was used during the altercation. 

Officers arrested Bullard, who later stated to police that after he was sprayed with pepper spray, he feared for his life, so he "fired his weapon in self defense." Police believe Bullard exited his home to fire his gun again before returning back inside his home. 

As of March 12, the new court documents said that "further investigation has identified evidence that negates the allegations as charged." 

According to those documents, the investigation remains ongoing, but the five counts of second-degree assault against Bullard will be dismissed "without prejudice."
