Backpack Bomber, Kevin Harpham, to be sentenced Tuesday

SPOKANE-- Following one delay the Backpack Bomber is scheduled to be sentenced Tuesday morning.

Kevin Harpham pleaded guilty to building and planting a bomb along the Martin Luther King Jr. parade route last January.

Kevin Harpham took a plea deal putting his sentencing range between 27 to 32 years.

His defense wants the low end of the range while the prosecution wants the full 32 years.

For a case of this level it has moved quickly through the court system.

As part of Kevin harp ham's plea deal for building and planting the back pack bomb he faces 27 to 32 years in federal prison.

Attorneys are arguing over the five year range.

Prosecutors say because the backpack bomb had the potential to hurt or kill many people Harpham deserves the full sentence.

They showed the destructive potential with this re-creation of the backpack bomb.

The defense maintains the bomb did not explode and Harpham has no other criminal history.

The judge has thanked Harpham and his legal team for helping the judicial process move swiftly but he has not indicated if that will factor into the sentence.

The original sentencing date was just under three weeks ago. The defense asked for a continuance to research the federal definition of explosive device.
