Man accused of four counts of first-degree murder in Kellogg files motion to suppress confession

Attorneys filed the motion asking the court to suppress all statements acquired by a Shoshone County Sergeant due to Miranda Rights violations.

KELLOGG, Idaho — The man accused of murdering four of his neighbors in Kellogg recently filed a motion asking the Court to suppress evidence.

Majorjon Kaylor and his attorneys filed the motion on Friday, October 20 saying they are asking the court to suppress all statements acquired by a Shoshone County sergeant due to Miranda Rights not being read.

The motion states that law enforcement interrogated Kaylor without reading Miranda Rights both at the scene and during his later interview. Miranda Rights were finally read mid-interview, which Kaylor’s attorneys called a “deliberate law enforcement tactic and objectively ineffective.” They go on to say that Kaylor’s 5th and 6th Amendment rights were violated.

Kaylor’s attorneys are asking for a hearing to be set where they can present evidence and arguments in support of the motion.

Kaylor has been charged with four counts of first-degree murder after he allegedly shot four of his neighbors. Kaylor and his wife say there was an incident where one of the neighbors had engaged in inappropriate behavior in front of Kaylor’s wife and their young children.

When police arrived at the scene and apprehended Kaylor, he is reported saying he "snapped," "lost it" and "did something about it."

Kaylor pleaded not guilty to all counts of first-degree murder at his arraignment in September. His trial is set to begin on Jan. 9, 2024. The state of Idaho previously stated it doesn't intend to seek the death penalty in this case.
